General Terms and Conditions

1. Scope of Application

​

These General Terms and Conditions (hereinafter referred to as “GTC”) apply in their current version to all contracts concluded between Apex Media (hereinafter “Provider”) and the Customer regarding photo, video and drone productions.
Deviating terms and conditions of the Customer shall only apply if the Provider has expressly agreed to them in writing.

2. Booking and Conclusion of Contract

​

Bookings may be made via email, telephone, or the online booking form.
A booking constitutes a binding offer by the Customer.
The contract is concluded once the Provider issues written confirmation or begins execution of the agreed service.
The Provider reserves the right to reject bookings without providing reasons.
The Customer is obliged to provide complete and truthful information (location, participants, timings, requirements, etc.).

 

3. Scope of Services and Prices
​

The exact scope of services results from the respective offer or agreed service description (e.g., photo reportage, video production, drone flights).
All stated prices include VAT.
Payment is generally due on the day of service or within the agreed payment period after invoicing.
The Provider may require a deposit to confirm a booking.​

4. Cancellation Rights and Conditions

​

Cancellations must be submitted in writing or by email.
Cancellation fees apply as follows:

  • Up to 7 days before the agreed date: no fee

  • 6 to 2 days before the agreed date: 50% of the agreed price

  • Less than 48 hours before or in case of no-show: 100% of the agreed price

The relevant time for compliance with deadlines is the moment the cancellation is received by the Provider.

 

5. Rights and Usage of Photo and Video Material

Unless otherwise agreed, all photo and video material remains the intellectual property of the Provider.
Upon full payment, the Customer receives a simple (non-exclusive) usage right for the agreed purpose (e.g., social media, website, print).
Any further use, editing, commercial resale or archival licensing requires prior written consent from the Provider.
The Provider may use selected footage for their own promotional purposes (portfolio, website, social media), unless the Customer objects in writing before production begins.

 

6. Drone Operations

​

All drone flights are conducted in accordance with legal regulations, flight zones and weather conditions.
The Provider reserves the right to cancel or adjust planned drone operations at short notice for safety or legal reasons.
If drone flights cannot be carried out due to weather, airspace restrictions or official regulations, this does not entitle the Customer to a price reduction as long as alternative footage is possible.

 

7. Customer Responsibilities & Cooperation

The Customer must ensure that all individuals being filmed or photographed are informed and have given consent (right to one’s own image).
The Customer is responsible for ensuring that all agreed locations are accessible and that required permissions have been obtained.
If the Customer or any relevant person arrives under the influence of alcohol, drugs or impairing medication, making safe or professional work impossible, the Provider is entitled to cancel or terminate the assignment.
In such cases, the agreed fee shall be payable as a cancellation charge.

 

8. Liability

​

The Provider is liable only for damages caused by gross negligence or intent.
Liability for slight negligence is excluded.
The Provider assumes no liability for technical issues (e.g., drone GPS errors, sudden weather changes, unforeseen disruptions).
The Customer is liable for any damages caused by themselves or members of their group.

 

9. Service Failure / Force Majeure

​

In the event of weather-related issues, technical failures, official restrictions, illness, accidents, force majeure or other unforeseen circumstances, the Provider may postpone or cancel the assignment.
In such cases, the Provider will offer replacement dates.
Further claims (e.g., compensation for damages) are excluded.

 

10. Data Protection
​

​Personal data is processed exclusively for the purpose of fulfilling the contract.
Details regarding data processing are provided in the Provider’s privacy policy available on the website.

 

11. Final Provisions

​

Should individual provisions of these GTC become invalid, the validity of the remaining provisions shall remain unaffected.
A provision that most closely reflects the economic intent of the invalid clause shall apply instead.
Austrian law applies.
The place of jurisdiction is the registered office of the Provider.
